In June 2010, new certification and licensing requirements were established for the operation of fixed (non-rotating) telehandlers in New York City. These changes are set to take effect on November 7, 2024, and aim to enhance safety standards for operators. The following summary outlines the key provisions regarding operator certification, licensing requirements, and exemptions related to the use of fixed telehandlers, ensuring compliance with the updated regulations.
**New Requirements for Fixed Telehandlers:**
1. **Certification:**
- Operators must have NCCCO certification when using a fixed telehandler to:
- Move a suspended load.
- Use hook, jib, concrete bucket, vacuum, or magnetic attachments.
2. **Licensing:**
- If equipped with a hoisting mechanism, operators need a NYC Class A, B, C, or Limited Boom Truck/Telehandler license.
- For booms over 200 ft or capacities over 50 tons, operators must hold a Class A or B Hosting Machine Operator license, regardless of hoisting mechanisms.
3. **Exemptions:**
- No certification or license required for operations in:
- Industrial/commercial plants, ships, or barges.
- Excavation, demolition, tree trimming, and aerial work.
- Telehandlers with a rated capacity of 1 ton or less.
4. **Fork Usage:**
- No certification or license needed for lifting loads on forks if:
- Boom length ≤ 200 ft.
- Capacity ≤ 50 tons.
- Not equipped with a hoisting mechanism.
- No suspended loads.
